WILDBRAND CLIENT TERMS OF SERVICE

1. Introduction
Welcome to Wildbrand. These Terms & Conditions ("Terms") govern your use of our services and products. By working with us, you agree to these Terms. Please read them carefully before proceeding with any work.

2. Fair Use Guidelines
At Wildbrand, we are committed to delivering high-quality services in a timely manner. All requests submitted by clients will be acknowledged and responded to within 2 business days. Please note that this response time does not guarantee immediate action, and the timeline for completion will depend on factors such as the availability of necessary information, team capacity, and the current workload. Upon submitting your request, Wildbrand will provide an estimated timeline for completion based on the current project scope and workload. These timelines are subject to adjustment and will be communicated to you accordingly.

3. Project Timelines & Expectations
Unless otherwise specified, we allocate 3 months for each project from start to finish. This is the time we require to complete your work. Delays caused by you—such as failure to provide necessary information or timely feedback—will extend the project timeline and may result in the following:

  • If your project extends beyond 3 months due to delays, you will be placed on a month-to-month rolling plan with Wildbrand, or the project may be suspended indefinitely or terminated.

  • Any disruptions to your allocated timeline exceeding 2 weeks will incur additional costs or may result in suspension or termination of the project.

Wildbrand only takes on a limited number of clients at any given time to ensure we have the necessary time, energy, and capacity to complete your project to the highest standard. We ask for your cooperation in maintaining clear communication and meeting deadlines to ensure a smooth project experience.

4. Project Cancellation & Termination
In the event that you wish to cancel or pause the project, you must provide written notice to Wildbrand at least 30 days in advance. If the project is canceled after work has begun, you may be liable for any work already completed, and cancellation fees may apply.

If Wildbrand experiences delays in project completion due to your failure to provide required information, approvals, or feedback, we reserve the right to pause or terminate the project. In such cases, an adjusted final invoice will be provided for work completed up to that point.

5. Payments & Invoicing
Wildbrand requires timely payments for services rendered. You will be provided with an invoice for the agreed-upon services, and payment must be made within the payment terms specified on the quote/invoice. Failure to remit payment in accordance with the terms may result in project delays, suspension until payment is received, or termination of your project.

6. Refund Policy
Due to the digital nature of our products and services, Wildbrand operates a no-refund policy. All payments are final upon receipt. We provide a clear agreement on project scope, and any changes or adjustments made will be communicated and agreed upon in writing. In the event of project suspension or termination caused by client delays, no refunds will be issued.

7. Confidentiality
Wildbrand acknowledges that any information provided by you during the course of your project is confidential. We agree not to disclose any information to third parties without your explicit consent, except as required by law.

8. Intellectual Property Rights
Unless otherwise agreed, you retain ownership of all intellectual property provided by you for the project. Wildbrand retains ownership of all intellectual property created during the project (including, but not limited to, designs, templates, and other creative work) until full payment has been received. Upon payment completion, intellectual property rights for the final work product will be transferred to you, excluding any materials or resources owned by Wildbrand.

9. Limitation of Liability
Wildbrand will not be held liable for any indirect, consequential, or incidental damages arising from the use of services provided. Our liability is limited to the fees paid by the client for the specific project in question.

10. Dispute Resolution
In the event of a dispute, both parties agree to make a good-faith effort to resolve the matter amicably. If resolution cannot be reached through informal negotiations, the dispute will be settled through arbitration in accordance with applicable laws in Western Australia

11. Governing Law
These Terms will be governed by and construed in accordance with the laws of Western Australia. Any legal proceedings arising under or related to these Terms shall be brought in the courts located in Western Australia.

12. Acceptance of Terms
By engaging with Wildbrand and agreeing to a quoted project, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you have any questions or concerns, please contact us directly before proceeding with your project.
